NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. HOW TO ENTER
a. The WJFK-FM/MILLER LITE ULTIMATE HARLEY GIVEAWAY contest (the “Contest”) will begin at approximately 6:00am Eastern Time (“ET”) on 5/8/2008 and end at approximately 12am ET on 6/29/2008. (“Contest Period”)
b. To participate in the contest, you must enter via the following methods:
ON AIR: Listen to WJFK-FM (“the Station”), Monday-Friday, 6am-10am ET, during the Contest Period for your chance to qualify to participate in the final giveaway on 6/28/08 10:00pm ET to 6/29/08 12:00am ET at Kelly’s Irish Times, 14 F St NW, Washington DC (“Grand Prize Event”). During this time the Station will instruct contestants to call in when the cue to call is aired. When the cue to call is aired, the contestant must be the 1st caller that successfully calls in on the stations call in line at 866-44-JUNKS (58657) to be eligible to participate in the trivia contest. The contestant must then correctly answer one (1) trivia question as prepared by the Station. If the contestant correctly answers the trivia question, they will become a qualifier and will be eligible to participate in the Grand Prize Event, upon confirmation of eligibility (“Qualifier”). If the contestant answers incorrectly, the station will take subsequent calls until a caller successfully calls in on the stations call in line and correctly answers the same trivia question asked to them by the Station. All callers must provide their first and last names, complete address including zip code, telephone number, and date of birth to confirm eligibility. All contest episodes will be conducted weekdays between, 6:00am-10:00am ET during the contest period. The Station will qualify a maximum of two (2) contestants per day over the air during the Contest Period, for maximum of seventy-eight (78) Qualifiers via the on air method of entry.
The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.
ONLINE/ON AIR: Register for the WJFK-FM FreeLoaders database by completing the registration form on WJFK.com with your first and last name, complete address including zip code, telephone number, date of birth, and a valid email address. On 5/21/08, 6/4/08, and 6/18/08 WJFK will send an Eblast out to all registered WJFK FreeLoaders containing a contest password and a date/time to call into The Junkies (sometime Monday-Friday, 6am-10am ET). At this specified date/time, the first caller that successfully calls in on the stations call in line at 866-44-JUNKS (58657) and gives the correct contest word contained in that Eblast will become a qualifier, pending verification of eligibility, and will be eligible to participate in the Grand Prize Event, upon confirmation of eligibility (“Qualifier”). Three (3) qualifiers will be selected via this method of entry.
c. ONLINE: WJFK will host three (3) separate online contests which will be held on the Contest page of WJFK.com. The first contest will run 6:00am ET 5/12/08 through 11:59pm ET 5/18/08. The second contest will run 6:00am ET 5/26/08 through 11:59pm ET 6/1/08. The third and final online contest will run 6:00am ET 6/9/08 through 11:59pm ET 6/15/08. To enter any of these contests, during the above dates and times log onto www.WJFK.com and complete an official online entry form by completing your first and last name, complete address including zip code, telephone number, date of birth, and valid email address by the deadlines listed above. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches. At the completion of each of these contests, WJFK will randomly select one (1) entry to become a qualifier and will be eligible to participate in the Grand Prize Event, upon confirmation of eligibility (“Qualifier”). Selected Qualifiers will be notified by 5:00pm ET the Monday following the completion of the contest. Three (3) Qualifiers will be selected via this method of entry.
ON SITE: To enter contestants must complete an entry form (while supplies last) at any of the locations listed in attached Exhibit A. The contestant must provide their first name and last name, complete address, city, state, zip code, home telephone number. Entry forms must be submitted to the official ballot box. The deadline to submit entry forms is fifteen (15) minutes prior to the end of each on-site event. At the end of each appearance the Station will select either one (1) or two (2) entry forms, according to Exhibit A, in a random drawing from all of the eligible entries received during that particular appearance. These contestants will become qualifiers and will become eligible to participate in the Grand Prize Event, upon confirmation of eligibility. A maximum of twenty-eight (28) keys will be given away via the on onsite means of entry. No photocopies or mechanically reproduced entries will be accepted. Contestants must be present to claim their position as a key holder. No physical keys will be awarded during any of the station appearances; rather they will be distributed the night of the final giveaway as listed in 4B below.
c. During the contest period each person may qualify only once to participate in the Grand Prize Event.
2. ELIGIBILITY RESTRICTIONS
a. The contest is open to all WJFK FM listeners who are twenty-one (21) years of age or older at the time of entry who legally reside in the Washington DC metropolitan area. Employees of the Station, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the DC metropolitan area and the members of their immediate families and/or households are ineligible to participate or win.
b. Only one winner per household per 60 days. Only one winner per household is permitted in any Station contest.
c. To qualify to participate and/or win, contestants must possess a valid driver’s license and have proof of or be able to obtain automobile liability insurance and/or any other state automobile insurance requirements as of 6/28/08 and prior to taking possession of the prize. Winner of the grand prize must possess a valid motorcycle license and have proof of motorcycle insurance prior to receiving the prize.
d. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3. PRIZES
a. One (1) grand prize will be awarded. The Grand Prize consists of the following: one (1) Harley Davidson Sportster XL 1200N (ARV $10,000.00); one (1) accessories package including large tool box, garage floor, one (1) case of oil, cleaning bucket with supplies, neon clock, motorcycle covers for fender and tank, motorcycle cover, tin sign, mini Harley fridge, air gauge, gift card in the amount of $775.00 to be used to purchase a Harley leather jacket and helmet, dealer shirt and hat, and assorted dealer accessories TBD by the dealer (ARV $5,000.00). ARV of the grand prize = $15,000.00.
b. Winner will be solely responsible for all vehicle title, tax, tags, proof of insurance and license and registration fees, emissions inspection, freight, delivery, dealer prep, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle. Winner must provide proof of insurance and a valid motorcycle license. All obligations must be met before contestant takes possession of the vehicle. The winner will accept the chosen prize vehicle "as is." Released Parties accept no responsibility for repairing any real or supposed damage to the prize vehicle from this contest. If the prizes are not available at sweepstakes end including vehicle color, a substitution of equal or greater value will be made at the Participating Station choice. Neither the Station nor the other sponsors have made or are responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize vehicle, including without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the vehicle. Any additional vehicle options (including the interior and exterior color of the prize) not specified herein are subject to availability and will be the responsibility of the winner. Upon confirmation of eligibility, all prizes will be awarded to the winner on 6/27/08. The winner will be responsible for all fees, expenses and obligations listed above.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the contest are final.
b. Up to one-hundred six (106) qualifiers will be chosen as described in 1b above. One (1) grand prize winner will be selected on the evening of 6/28/08 at Kelly’s Irish Times, 14 F St NW, Washington DC. All Qualifiers must register with the Station at the designated check in area beginning at approximately 8:00pm on 6/28/2008 and no later than 10:15pm in order to be eligible to participate in the Final Event. A contestant not present by 10:15pm will forfeit his/her chance to win the grand prize. Upon checking in, each contestant will randomly draw a number from a bag to determine the order in which they will select a key to test in the Harley Davidson Sportster XL 1200N. Each Qualifier, based on the number they selected will come up and randomly select a key and from the bag and will test it in the Harley Davidson Sportster XL 1200N. The first contestant whose key starts the motorcycle will win the grand prize, upon confirmation of eligibility. Once the vehicle has been started the contest will be discontinued immediately and no other contestants will have an opportunity to start the vehicle. In the event that all Qualifiers try their keys and none of the keys start the vehicle, the station will select one (1) winner in a random drawing from among all eligible Qualifiers who registered for the Final Event on time. In the event that not all 106 Qualifiers check in by the specified time, the Station will only include enough numbers in the bag to cover those Qualifiers who have checked in. Likewise, the Station will only include enough keys to cover one per person in the bag so that there is no chance the winning key will not be drawn.
b. Odds of becoming the grand prize winner depend upon on the number of qualifiers who check in at the Grand Prize Event by the specified time.
c. The on-site qualifier(s) and Grand Prize Winner must be present to win.
d. Winners must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, selected contestants and winner agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event, including any of the seventeen (17) appearances mentioned in 1b and the Grand Prize Event mentioned in 4b are delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
h. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WJFK-FM, 10800 Main St, Fairfax VA 22030.
6. INTERNET SWEEPSTAKES PRIVACY POLICY
a. By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: http://www.wjfk.com/pages/707555.php.
