1. HOW TO ENTER THE CONTEST
a. The WJFK Fat Dog Contest (“Contest”) will begin on or around 4/14/08 at 7:00am Eastern Time (“ET”) and will end on 8/4/08 at 7:00am EST (“Contest Period”).
b. To participate in the Contest, starting at 7:00am on 4/17/08 go to www.wjfk.com, go to the Contest page complete the online entry form and upload a photo of your dog. The person uploading the photo must be the owner of the dog in the photograph. You must include your first name and last name, complete address, city, state, zip code, home telephone number and a valid email address in the online entry form. Contestants will be required to agree to a photo submission release in order to submit their entry. Entries must be received by 5:00pm ET 5/25/08. Beginning on 5/26/08 at 7:00am ET, all eligible photo entries will be posted on the WJFK website and listeners may begin to vote for their favorite dog photograph. Voting will end 6/6/08 at 5:00pm ET. The dog with the most online votes will automatically advance to the top ten (10) semi-finalists. A panel of judges (Jen, Darby, Jacqueline and Susan from Pawticulars and Cakes from the Junkies) will review all eligible entries received and select nine (9) additional entries based on which dogs they feel have the greatest need to lose the weight and the greatest chance of success from the diet program. The top ten (10) semi-finalists will attend a station event on 6/7/08 from 12p-2p ET at Hotel Helix, 1430 Rhode Island Ave. NW, Washington, DC 20005 and will be assessed in person by the panel of judges as previously stated to select three (3) finalists to compete in the Contest. After the three (3) finalists have been selected, each finalist will be weighed to determine each of their starting weights for the Contest.
c. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. Station’s computer is the official time keeping device for the sweepstakes. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.
d. Each Photograph Entry must be the original creative photographic work and/or property of the Contestant and must not contain copyrighted materials or any other materials, which may be restricted, prohibited, or outlawed by Federal, state or local laws. By uploading their photo on www.wjfk.com, the contestants and the winner agree to have their name, photo, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation. All Photograph Entries and their content become the property of WJFK-FM and will not be returned. WJFK-FM, at its sole discretion, reserves the right to disqualify and/or destroy any Photograph Entry if such Photograph Entry contains nudity or partial nudity; illegal, indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such Photograph Entry contains material whose content is deemed at the sole discretion of WJFK-FM to be unsuitable for public viewing or posting via the Internet. By participating in the contest, participants agree to continue to comply with the Official Rules of the Contest and any rules or guidelines established by WJFK-FM or its representatives regarding entry, participation or the prize of this Contest. Participants that fail to comply with the rules or guidelines established by WJFK-FM, representatives of WJFK-FM, in their sole discretion, may disqualify the contestant from participating in the Contest and will waive any chance the contestant may have had of winning the Contest.
2. ELIGIBILITY RESTRICTIONS
a. The contest is open to all WJFK-FM listeners who are 21 years of age or older at the time of entry and who legally reside in Washington DC Metro area. Employees of WJFK-FM (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the DC metropolitan area and the members of their immediate families and/or households are ineligible to participate or win.
b. Only one winner per household per 60 days. Only one winner per household is permitted in any Contest administered by the Station.
c. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act. The winner must present valid photo ID such as Driver’s License or Government Issued ID and Social Security Number.
3. PRIZES:
a. One (1) grand prize: 2-nights standard double occupancy at Hotel Helix in Washington DC valued at $500.00 to be completed by 12/20/08, dinner certificate valued at $150.00 valid at a participating restaurant on The Hill [SPECIFY EXPIRATION DATE AND RESTRICTIONS OF USE.], one (1) case of non-alcoholic Boswer Beer (special beer for dogs) valued at $156.00, Nature’s Variety brand dog food for one (1) year valued at $500.00. Total ARV for grand prize package: $1,306.00. The grand prize winner will also receive a finalist prize and a qualifying prize. Grand prize winner may be required to present a valid credit card at the time they check in to the hotel.
Three (3) finalist prizes will be awarded, one (1) finalist prize will be given to each of the three finalist dogs/dog owners. Each finalist prize will be distributed evenly over nine (9) weeks and will include: nine (9) classes in nutrition, nine (9) classes in dog training, nine (9) classes in physical fitness, nine (9) bags of Nature’s Variety brand dog food. All classes must be scheduled with the Pawticulars staff ahead of time and must be taken by [SPECIFY DAY OF THE WEEK THAT YOU WANT TO DESIGNATE AS THE LAST DAY OF THE WEEK.] of that week, then that class will be forfeited. (ARV per week: $300.00; total ARV for each finalist: $2,700.00) All three (3) finalists will also receive a qualifying prize.
Ten (10) qualifying prizes will be awarded, one (1) qualifying prize will be given to each of the ten semi-finalist dogs/dog owners. Each qualifying prize will include: one (1) six-pack of non-alcoholic Bowser Beer (special beer for dogs), diet greenies, and dog accessories (ARV per prize package: $100.00)
b. All tax forms must be completed by the winner(s) within thirty (30) days of winning the contest. Failure to complete tax forms will result in the forfeit of the position.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of Contest Entities management with respect to the Contest are final.
b. Each of the three (3) finalists will be placed on a diet of Nature’s Variety brand dog food in association with Pawticulars, who will be providing the food for the finalists. The finalists will be on this diet 6/16/08-7/27/08. All three (3) finalists will be weighed at the station event on [SPECIFY DATE.] at [SPECIFY LOCATION.] which will be their starting weights. The owners of each finalist will be required to sign a participant release form at this time in order to be eligible to compete. The finalists will need to follow the suggestions of Pawticulars, including their suggestions on weight loss plan and amounts of food to eat. A finalist will be disqualified in the Station and Pawticulars’ sole discretion if they are not following these rules or if they are found to be putting their dog’s health at risk. At the end of the Contest Period, all three (3) finalists will be required to attend a weigh in on [SPECIFY DATE.] at [SPECIFY LOCATION.] for their final weigh-ins. The finalist which has lost the highest percentage of weight lost under this program will be declared the winner. In the event of a tie the two tied contestants will be entered into a drawing and one winner will be drawn at random immediately.
c. Odds of winning based upon the number of votes received.
d. Winner need not listen to win. Winner must be present at both the initial and final weigh-ins to win.
e. Winner will be notified on-site and via telephone at or around 3:00pm ET 7/27/08. Winner must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within three (3) business days of notification attempt or prize will be forfeited and an alternate winner may be chosen by randomly selecting from remainder of entrants.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
e. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
